This website (Website) is owned and operated by the Helen T. Lin Legacy Initiative (the Project). These Terms of Use set forth the terms and conditions under which you may use our Website. The Website offers visitors information honoring the memory of Helen T. Lin, celebrates and recognizes her former students and others among her living legacy, and provides opportunities to discuss, explore, and deepen understanding of China including its people, culture, society, history, language, commerce, global relations and impact. As a project which is fiscally sponsored by Inquiring Systems Inc. (Fiscal Sponsor), the Project is not affiliated with any other institution, organization, or government entity.

 

By accessing or using this Website, you agree that you have read, understood, and agree to be bound by these Terms.

 

Who can use the Website

 

In order to use our Website, you must be of the legal age of majority in the jurisdiction where you are accessing our website, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement (Agreement). You are not allowed to use this Website and/or receive services if doing so is prohibited by such jurisdiction or under any law or regulation applicable to you.

The Website and all materials thereon or transferred thereto, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are either the exclusive property of the Project, in the public domain, or have been made accessible on our site with the express permission of the materials’ owner(s). You may access these materials for personal use only.  Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works thereof without the express written permission of the Project’s Advisory Board.  Nor are you permitted to suggest the existence of any other relationship, endorsement or affiliation with the Project or the posted materials without our prior express written permission.

 

Upload of third-party content

 

You recognize and agree that by uploading or submitting any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, comments, blogs, text, and/or academic or literary works) through any means to the Website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You further agree that such content is not confidential and consent that the uploaded/transferred content may be publicly displayed at the Website.

 

You also agree that the Project is free to use any ideas, concepts, know-how, or techniques that you send us for any purpose, without compensation. However, we will not release your name or otherwise publicize the fact that you submitted materials or other information to us without your prior written consent for us to do so.

 

No warranty

 

We are unable to nor responsible for keeping the information available on the Website current and accurate at all times, particularly with respect to content provided by third parties.  Likewise, we cannot review, control, or otherwise ensure the accuracy, reliability or availability of information found in external websites, to which a link can be found on this Website.  Accordingly, we provide no representation or warranty or in any way guarantee the accuracy, reliability, completeness or timeliness of any information on the Website.

 

Right to suspend or cancel user account

 

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.

You agree to indemnify and hold the Project, members of its Advisory Board, and its Fiscal Sponsor harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limits of Liability

 

To the maximum extent permitted by applicable law, in no event shall the Project be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. 

To the maximum extent permitted by applicable law, the Project assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury, emotional harm, loss, expenses, or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

 

Right to change and modify Terms

 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

 

Governing law

 

This Agreement is governed by the laws of the state of California, U.S.A., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to this Agreement will be the Sonoma County Superior Court, California. 

 

 

Informational emails and content

 

You agree to receive update messages and materials from us, by mail or email or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such notices – please just notify us at any time by sending an email with your request to htl.legacy@gmail.com.

 

Website membership

 

By creating a login to this website, you become a member of the website’s “Tiger Community”.  As part of this membership, you gain access to create and update a personal profile which can be made visible to other community members at your discretion.  This community consists of Helen Lin's students, colleagues, family, and their invited guests.  Requests to create membership accounts will be subject to approval by the Project’s advisory board.

 

A core purpose of the Tiger Community is the open and free exchange of ideas and experiences from its diverse members.  We reserve the right to remove any member who disregards the mission of the Project, including without limitation, knowingly posting hateful or violent material, ad hominin attack of or disclosure of confidential information about other members, dissemination of known disinformation, or otherwise engaging in repeated violation of the Terms.    

The perspectives expressed in Tiger Talks and other exchanges hosted by the Project are those of the speakers themselves and not of the Project, its Advisory Board, or Fiscal Sponsor.
